Limited Warranty

EXPRESS WARRANTY: Shenandoah Shutters, LLC (the "Seller") warrants to the purchaser (the "Purchaser") and subsequent owners who provide proper notice as set forth below (together, the "Customer") the structural integrity, as defined below, of its shutters for 100 years and the lacquer finish on the shutters for 25 years (the "warranty). Seller warrants that the materials and workmanship of the shutters are free from defects, and the lacquer finish on the shutters is guaranteed not to crack or peel during normal use in a climate-controlled area. This Warranty is effective upon full payment by the purchaser and is transferable so long as the new owner notifies the Seller in writing within 30 days after taking ownership of the shutters (e.g., purchasing the premises in which the shutters are installed). Only the original installation is covered under this warranty. Should there be a defect in the product or one or more of its components, the Customer must notify the Seller in writing within 30 days of discovery of the claimed defect. Within a commercially reasonable time after receipt of such notification, the Seller will assess the product and its alleged defect and either repair or replace at the Seller's sole discretion, the nonconforming parts or components. Such repair or replacement shall be the sole remedy hereunder. Defective shutters may not be shipped to the manufacturer without prior written consent.

"Structural Integrity" specifically refers to the joints at the intersection of the vertical and horizontal structural members. This Warranty applies only to shutters properly sized, configured and installed in accordance with the Seller's recommendations in a climate-controlled environment (i.e., the interior of a home or business). This Warranty does not cover normal wear and tear. Furthermore, the Seller is not responsible for repairing or replacing shutters or component parts damaged by the Customer's misuse of the product ("Product Misuse"). Product Misuse includes, without limitation, evidence that the shutters were dropped or otherwise mishandled (e.g., wood at the corners or edges is dented or the surface of the shutters is scarred); that the shutters were subjected to excessive moisture or that abrasive cleaning agents were used on the shutters. Furthermore, the Warranty does not cover damage caused by using the "tilt control bar" as a handle. The tilt control bar serves to adjust the angle of the louvers by means of interlocking staples. Should one staple pull out, the Seller will repair or replace the staple. Should additional adjacent staples pull out partially or completely, however, there will be a presumption that the tilt control bar was used as a handle to pull open the shutters, which activity is considered Product Misuse.

The following sizes, configurations and installations are not covered under this Warranty: Installations in which any of the panels extend more than 40˚ from the hanging hinges, unless the panels are supported by an overhead track; changes in the dimensions of the components (e.g., stiles, rails, hanging strips) requested by the Purchaser; panels which the Sellers recommends to be constructed with additional horizontal structural supports but the Purchaser insists that the supports be deleted; panels over 36" in width; and installations in which the Seller suggests the use of magnets, cleats, additional hinges, etc., but the Purchaser deems the use of these items as unacceptable.

LIMITATION OF WARRANTIES. THE SELLER HEREBY EXPRESSLY DISCLAIMS ANY AND ALL EXPRESS OR IMPLIED WARRANTIES BEYOND THOSE SET FORTH ABOVE, INCLUDING ANY AND ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL THE SELLER BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY (PUNITIVE) DAMAGES, EVEN IF THE SELLER HAS BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES. THE CUSTOMER'S REMEDIES SHALL BE LIMITED TO REPAIR OR REPLACEMENT AS DESCRIBED ABOVE.
